1. ACCEPTANCE OF TERMS

By accessing or purchasing from Zor Ka Jhatka ("we," "us," "our"), you agree to be bound by these Terms of Service in full. If you do not agree with any part of these terms, you must not use our website or place an order. These terms apply to all visitors, customers, and anyone who accesses our store.

2. ABOUT OUR PRODUCTS

Zor Ka Jhatka sells original, independently created art prints inspired by the visual culture, aesthetic traditions, and cinematic history of Bollywood and Indian cinema. All artwork sold on this store is:

  • Created independently by or for Zor Ka Jhatka
  • Inspired by the general themes, eras, and visual language of Indian cinema
  • Produced as original artistic works and not reproductions of any copyrighted material

Our prints are decorative art pieces intended for personal, non-commercial display.

3. INTELLECTUAL PROPERTY — NO STUDIO AFFILIATION (IMPORTANT)

3.1 Independent Creator Statement

Zor Ka Jhatka is an independent art and print store. We are not affiliated with, endorsed by, sponsored by, licensed by, or connected in any way to any of the following or their parent companies, subsidiaries, affiliates, or successors:

  • Dharma Productions
  • Excel Entertainment
  • Eros International
  • T-Series
  • Rajshri Productions
  • Balaji Telefilms
  • Red Chillies Entertainment
  • Reliance Entertainment
  • Sony Pictures Networks India
  • Disney Star India
  • Zee Entertainment
  • Any other Bollywood, Indian, or international film studio, production house, distributor, or rights holder

The names of films referenced in product titles are used solely for descriptive and artistic reference purposes to identify the era, genre, or cultural inspiration behind the artwork. Such references do not imply any official relationship, licensing arrangement, or endorsement.

3.2 No Official Merchandise

Our products are not official merchandise. We do not sell licensed studio products. No product sold on this store should be interpreted as being officially produced, approved, or endorsed by any film studio, production company, actor, director, musician, or public figure associated with Indian cinema.

3.3 Original Artwork

All artwork sold on this store is original and independently created. Our art is inspired by the aesthetics, color palettes, typography traditions, and visual culture of Bollywood cinema as a cultural phenomenon. Any resemblance to specific copyrighted poster artwork, promotional materials, or licensed imagery is unintentional. We do not reproduce, copy, or directly replicate any copyrighted film poster, still, promotional image, or studio asset.

3.4 Ownership of Our Artwork

All original artwork created by or for Zor Ka Jhatka remains the intellectual property of Zor Ka Jhatka. You may not reproduce, redistribute, resell, or use our artwork for commercial purposes without our explicit written permission. Purchase of a print grants you a personal, non-commercial license to display the artwork in your home or private space only.

3.5 Takedown and Disputes

If you are a rights holder and believe any product on our store infringes on your intellectual property, please contact us immediately at bhavyanar0@gmail.com with full details of your claim. We take intellectual property concerns seriously and will review and respond to all legitimate claims promptly. We reserve the right to remove any product at our sole discretion.

4. ORDERING AND PAYMENT

4.1 Order Acceptance

Placing an order on our store constitutes an offer to purchase. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases of suspected fraud, pricing errors, product unavailability, or violations of these terms. If your order is cancelled after payment has been processed, you will receive a full refund.

4.2 Pricing

All prices are listed in Canadian dollars (CAD) unless otherwise stated. We reserve the right to change prices at any time without notice. The price charged will be the price displayed at the time of your order.

4.3 Payment

We accept major credit cards, Shop Pay, Google Pay, and other payment methods available at checkout. All payment processing is handled securely by Shopify. We do not store your payment information.

4.4 Taxes

Applicable taxes will be calculated and added at checkout based on your shipping address. You are responsible for any customs duties or import fees if applicable.

5. SHIPPING AND FULFILLMENT

5.1 Made to Order

All products are printed on demand. Orders are fulfilled within 3–5 business days of purchase. We do not maintain physical inventory.

5.2 Shipping Times

Estimated delivery times after fulfillment are 5–10 business days within Canada and the United States. These are estimates only and are not guaranteed. We are not responsible for carrier delays, weather events, customs holds, or any other circumstances outside our control.

5.3 Shipping Address

You are responsible for providing an accurate and complete shipping address. We are not responsible for orders lost or undeliverable due to an incorrect address provided by the customer. If you notice an error in your shipping address, contact us within 24 hours of placing your order.

5.4 Lost or Damaged Shipments

If your order arrives damaged, please contact us within 7 days of delivery with photographic evidence and we will arrange a reprint at no additional cost. If your tracking shows delivered but you have not received your order, please contact us and we will investigate with the carrier.

5.5 Geographic Restrictions

We currently ship to Canada and the United States only. We reserve the right to restrict shipping to certain regions at our discretion.

6. RETURNS AND REFUNDS

As all products are made to order, we do not accept returns or exchanges for change of mind, incorrect size selection, or buyer's remorse. We will only offer reprints or refunds in the following circumstances:

  • The product arrives visibly damaged or defective
  • The wrong product or size was shipped due to our error

All damage or error claims must be submitted within 7 days of delivery with supporting photos. Approved refunds will be processed to your original payment method within 5–10 business days.

7. PRODUCT DESCRIPTIONS AND ACCURACY

We make every effort to accurately represent our products including print sizes, colors, and materials. However, colors may appear differently on screen versus in print due to monitor calibration and printing variables. Minor variations in color are not considered defects and do not qualify for a refund or reprint.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Zor Ka Jhatka shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our store or products, including but not limited to loss of profits, data, or goodwill. Our total liability to you for any claim arising from a purchase shall not exceed the amount you paid for the specific product giving rise to the claim.

9. DISCLAIMER OF WARRANTIES

Our store and products are provided on an "as is" basis. We make no warranties, express or implied, regarding the fitness of our products for any particular purpose beyond personal decorative display. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Zor Ka Jhatka and its operators from and against any claims, damages, losses, costs, and expenses (including legal fees) arising from your use of our store, your violation of these Terms of Service, or your violation of any third party rights.

11. PROHIBITED USE

You agree not to use our store or products to:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of any party
  • Resell or commercially exploit our artwork without written permission
  • Engage in fraudulent transactions or chargebacks without legitimate cause
  • Harass, threaten, or harm any individual or group
  • Attempt to gain unauthorized access to our systems

12. GOVERNING LAW

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

13. CHANGES TO TERMS

We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Your continued use of our store after changes are posted constitutes your acceptance of the revised terms.

14. SEVERABILITY

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. ENTIRE AGREEMENT

These Terms of Service, together with our Privacy Policy, Return Policy, and Shipping Policy, constitute the entire agreement between you and Zor Ka Jhatka with respect to your use of our store and supersede all prior agreements and understandings.
